These Terms of Service ("Terms") govern your access to and use of spurfix.com (the "Site"), operated by Spurfix ("Spurfix," "we," "us," or "our"). Please read these Terms carefully before using the Site.

3. Products and Pricing

  • All product descriptions, images, and prices are subject to change without notice.
  • We make reasonable efforts to display product colors, features, and details accurately, but we do not guarantee that your device's display will accurately reflect the actual product.
  • We reserve the right, at our sole discretion, to limit quantities, refuse, or cancel orders, including orders that appear to be placed by resellers, distributors, or that involve suspected fraud or pricing errors.
  • Prices are listed in USD unless otherwise noted, and do not include applicable taxes, duties, or shipping fees unless stated.

4. Orders and Payment

  • By placing an order, you represent that you are authorized to use the payment method provided and that the information you provide is accurate.
  • We reserve the right to refuse or cancel any order for any reason, including suspected fraud, errors in pricing or product information, or unavailability of the product. If your order is canceled after payment, we will issue a refund.
  • Payment is processed securely through our third-party payment processors. We do not store your full payment card details.
  • Risk of loss and title for products pass to you upon our delivery to the shipping carrier.

5. International Orders

For orders shipped outside the United States, you are responsible for any customs duties, import taxes, and fees imposed by the destination country. These charges are not included in the purchase price or shipping cost and are the sole responsibility of the customer. Delivery times for international orders may vary due to customs processing.

6. Shipping and Delivery

  • Estimated shipping and delivery times are provided for convenience and are not guaranteed.
  • We are not responsible for delays caused by shipping carriers, customs, or circumstances beyond our reasonable control.
  • Please ensure your shipping address is correct at checkout; we are not responsible for orders shipped to an incorrectly provided address.

7. Returns, Exchanges, and Refunds

  • Items may be returned within 30 days of delivery, provided they are unused, unworn, and in their original packaging with tags attached.

  • Refunds will be issued to the original payment method within 7 business days of our receipt and inspection of the returned item.
  • Certain items (e.g., final sale, personalized, or hygiene-sensitive products) may not be eligible for return — see product listing for details.
  • Customers are responsible for return shipping costs unless the item was defective or incorrect.

8. Account Registration

If you create an account on the Site, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized use of your account. We are not liable for any loss arising from unauthorized use of your account.

9. Prohibited Conduct

You agree not to:

We reserve the right to suspend or terminate your access to the Site for violation of these Terms.

You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written permission.

11. User-Generated Content

If you submit reviews, comments, photos, or other content to the Site ("User Content"), you grant Spurfix a non-exclusive, royalty-free, worldwide, perpetual, and transferable license to use, reproduce, modify, publish, and display such User Content in connection with our business. You represent that you own or have the necessary rights to the User Content you submit and that it does not violate any third-party rights or applicable law. We reserve the right to remove any User Content at our sole discretion.

12. Third-Party Links and Services

The Site may contain links to third-party websites or services that are not owned or controlled by Spurfix. We are not responsible for the content, privacy practices, or terms of any third-party sites. Your use of third-party websites is at your own risk and subject to their respective terms.

13. Disclaimer of Warranties

THE SITE AND ALL PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SPURFIX AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING OUT OF YOUR USE OF THE SITE OR PRODUCTS PURCHASED THROUGH THE SITE. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID TO US FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. NOTHING IN THESE TERMS LIMITS ANY RIGHTS YOU MAY HAVE AS A CONSUMER UNDER APPLICABLE LAW THAT CANNOT BE WAIVED.

15. Indemnification

You agree to indemnify, defend, and hold harmless Spurfix and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms or your use of the Site.

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States of America, without regard to its conflict of law principles. 

If you are a consumer residing in the EU, UK, or another jurisdiction with mandatory consumer protection laws, you may be entitled to bring disputes in the courts of your country of residence, and mandatory local consumer protections will apply regardless of this governing law clause.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us on the Site, constitute the entire agreement between you and Spurfix concerning the Site and supersede any prior agreements.
